1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of ScaleWthUs's website and any services you purchase or engage from us, including web development, AI & automation, and video/social media production. By submitting a quote request, accepting a proposal, or making a payment to ScaleWthUs, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Our Services

ScaleWthUs offers, among other things:

  • Website design and development
  • AI and workflow automation (including n8n-based systems)
  • Social media management
  • Video production and drone filming

The exact scope, deliverables, timeline, and pricing for any engagement will be defined in a written proposal, quote, or agreement shared with you before work begins ("the Project Scope"). These Terms apply alongside — and in the absence of conflict, in addition to — any specific written agreement for a project.

3. Quotes & Proposals

Quotes provided through our contact form, email, or WhatsApp are estimates based on the information you provide and are valid for 15 days unless stated otherwise. Final pricing may be adjusted if the project scope changes after our initial assessment. Work begins only after a proposal is agreed upon, typically with an upfront deposit as outlined below.

4. Payment Terms

  • Most projects require an upfront deposit (typically 40–50% of the total quote) before work begins, with the balance due upon completion or in milestone-based installments as agreed in the proposal.
  • Ongoing services (e.g., social media management, automation maintenance) are billed on a recurring basis as specified in the service agreement.
  • Late payments may result in a pause of work or delivery until outstanding amounts are settled.
  • All prices are quoted in Indian Rupees (₹) unless otherwise agreed, and are exclusive of applicable taxes unless stated.

5. Revisions

Each project includes a defined number of revision rounds as specified in the proposal. Additional revisions beyond the agreed scope may incur extra charges, which we will communicate and agree upon before proceeding.

6. Client Responsibilities

To deliver your project on time, we ask that you:

  • Provide timely feedback, content, and any assets (logos, images, copy, credentials) needed for the project.
  • Ensure you have the rights to any materials you provide us for use in your project.
  • Designate a single point of contact for approvals where possible, to avoid conflicting feedback.

Delays in providing feedback or assets may extend the project timeline accordingly.

7. Intellectual Property

  • Upon full payment, you will own the final deliverables created specifically for your project (e.g., final website files, video edits, automation workflows), except where third-party licensed assets are involved (see Section 8).
  • ScaleWthUs retains the right to reuse general methods, frameworks, code snippets, and non-client-specific components developed during the engagement for future projects.
  • Unless otherwise agreed in writing, ScaleWthUs retains the right to showcase completed work (including screenshots, links, and descriptions) in our portfolio and marketing materials.
  • Until full payment is received, all deliverables remain the property of ScaleWthUs.

8. Third-Party Content & Tools

Projects may incorporate third-party tools, platforms, plugins, stock assets, or APIs (e.g., hosting providers, automation platforms, stock image libraries). Such third-party components are governed by their own licenses and terms, and any ongoing subscription or licensing costs are the client's responsibility unless otherwise agreed.

9. Timelines & Delays

We work diligently to meet agreed timelines. However, timelines are estimates and may be affected by factors such as delayed client feedback, scope changes, or circumstances beyond our control. We will communicate proactively if delays are expected.

10. Cancellation & Refunds

  • Either party may cancel a project with written notice. Work completed up to the point of cancellation will be billed accordingly.
  • Deposits are generally non-refundable once work has commenced, as they cover time and resources already allocated.
  • Refunds, if any, for undelivered work will be assessed on a case-by-case basis and communicated in writing.

11. Warranty & Support

We stand behind the quality of our work. Post-launch bug fixes related to our original build are typically covered for a limited period as specified in your proposal. Ongoing maintenance, feature additions, hosting, or third-party service costs beyond that period are available as separate paid support arrangements.

12. Limitation of Liability

To the fullest extent permitted by law, ScaleWthUs shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or deliverables, including loss of revenue, data, or business opportunities. Our total liability for any claim arising from a project shall not exceed the total amount paid by you for that project.

13. Confidentiality

We treat client information, business details, and project materials shared with us as confidential, and we will not disclose them to third parties except as necessary to deliver the agreed services or as required by law.

14. Termination

We reserve the right to suspend or terminate services if a client breaches these Terms, fails to make agreed payments, or engages in abusive or unlawful conduct toward our team. Upon termination, any outstanding fees for work completed become immediately due.

15. Governing Law

These Terms are governed by the laws of India, and any disputes arising from these Terms or our services will be subject to the jurisdiction of the courts in Andhra Pradesh, India.

16. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services or legal requirements. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
